Privacy and personal data management policy

This privacy policy complies with the provisions relating to the protection of personal data under Québec and Canadian law, including Bill 25.

  1. Purpose

This policy concerns data collected directly or indirectly by Rappels in the course of its activities.

This policy aims to allow all users and partners to understand clearly and precisely how their data is processed.

  1. General principle

Rappels does not collect any personal information about you unless you decide, at your sole discretion, to provide it voluntarily.

  1. Definitions

Personal information: information that relates to a natural person and allows that person to be identified directly or indirectly.

Non-personal information: any other data that does not meet the definition of personal information.

Personal Information Protection Officer: the person designated to comply with Québec law regarding personal information.

  1. Nature of the data collected

The data that may be collected by Rappels includes:

  • Personal data that you explicitly provide to us as part of an agreement you have chosen to establish with Rappels, including information intended to identify you. In this case, the agreement will clearly state the terms of protection and storage of this data;

  • Data that is automatically collected by third-party tools when you visit our website or during your digital interactions with Rappels (e.g., website management system, email system). The policy for managing this data is described in sections 8 and 9 herein.

These two types of data are in no way related.

  1. Use of personal information by Rappels

Personal information collected by Rappels is not disclosed to anyone other than its employees, representatives, or those necessary to fulfill the purposes for which the personal information was explicitly collected, and only to the extent that they require it to perform a function related to achieving the stated purpose.

Rappels is committed to ensuring that all individuals who have access to this information are bound by confidentiality agreements and comply with the principles of this policy.

  1. Access to your personal information

You can access the personal information you have provided to Rappels and request that it be updated, modified, or deleted by sending an email to info@rappels.ca.

In this case, you may be asked to provide appropriate identification. We will process access or modification requests in accordance with applicable law. Rappels has a very small team. We will do our best to respond within one month, depending on the nature of your request.

  1. Personal information protection measures

Rappels implements appropriate security measures to ensure the protection of personal information.

When Rappels deems it necessary or appropriate, it uses encryption and authentication tools or programs, or other methods, to protect certain personal information originating from or obtained through the web that Rappels stores or intends to store on its servers, computer management systems, or databases.

  1. Information exchanged and collected automatically on the web

You are free to access and use this website without any personal information being collected and without disclosing your identity.

However, when you visit any website, basic information is automatically exchanged between that website and the device you use to access it. This exchange allows the website administrator to obtain a range of information:

  • The name of the internet domain you used to access the website and your IP address (IP stands for "Internet Protocol," a unique number assigned to your computer or other device when it is connected to the internet. It allows documents to be delivered to their recipient without errors);

  • The type of browser and operating system you use to access the website;

  • The date and time you accessed the website and the pages you visited;

  • If you reached the website from another site, the name and address (URL) of that website, as well as the keywords (if any) you entered into a search engine that led you to the site;

  • Any other information about your browsing activity.

This information is necessary for the proper functioning of a website.

  1. Additional information collected on the web via cookies

The following information may be shared with Rappels through its web management tools:

  • Web pages visited;

  • Time spent on each page;

  • Information sent or received;

  • The names of files downloaded or uploaded.

This information is used by Rappels to monitor the performance of its website, for system administration and security purposes, and to make the website more user-friendly.

  1. Unsolicited submission of personal information

Rappels does not wish to receive personal or confidential information through its website or by email except as specifically intended, i.e., through a private agreement upon its express request.

Any information or other documents you may send outside of such a specific framework will be considered non-confidential.

  1. Email exchange with Rappels

You acknowledge and agree that emails you send to Rappels are not necessarily under its control and are not necessarily protected before arriving at its servers. The confidentiality of information transmitted in this way cannot be guaranteed until it is actually received on Rappels' servers.

If Rappels specifically requests that you provide personal or confidential information, the information received will be managed and stored securely.

  1. Limitation of liability

Rappels undertakes to take all reasonable steps to ensure an adequate level of confidentiality and security for personal information.

In the event of a cyberattack or an incident that poses a high risk to your rights, you will be notified of this breach as soon as possible, and Rappels will take the necessary measures to preserve the confidentiality and security of your personal information.

Notwithstanding the foregoing, you acknowledge and understand that no computer system offers absolute security and that a degree of risk is always present when transmitting personal information over the Internet.

You therefore agree that Rappels cannot be held liable for any breach of confidentiality, hacking, viruses, loss, theft, misuse, or alteration of personal information transmitted or hosted on our systems or those of a third party.

You also waive any claim in this regard, except in cases of gross negligence or willful misconduct on the part of Rappels. Consequently, you agree to exonerate Rappels and its officers, directors, affiliates, and partners against any and all damages of any kind whatsoever, whether direct, indirect, incidental, special, or consequential, arising out of or in connection with the use of your personal information.

  1. Governing law

This agreement, its interpretation, execution, application, validity, and effects are governed by the applicable laws in force in Québec, in the judicial district of Montréal.

  1. Legal disclosures

You agree and acknowledge that Rappels is also authorized to use, disclose, or communicate your personal information to the extent permitted or required by law, including pursuant to court orders.

  1. Changes to this policy

Rappels reserves the right to make changes to this policy at any time. Such changes will be posted on our websites and will take effect immediately upon posting.
